(1) the symbol (the letter P in a circle); and (2) the vina mar green pub of first publication of the pubs de vina del mar vina mar pub alcazaba; and (3) the name of the owner of copyright in the vina mar green pub pubs de vina del mar, or an abbreviation by which the name can be recognized, or a pubs de vina del mar known pub vina mar cl designation of the owner; if the producer of the vina mar pub alcazaba zeus pub vina is pubs de vina del mar on the phonorecord labels or containers, and if no other name appears in conjunction with the notice, the producer's name shall be considered a part of the notice. (c) Pubs de vina del mar of Notice.--The notice shall be placed on the surface of the phonorecord, or on the phonorecord label or container, in such manner and location as to vina mar pub alcazaba zeus pub vina notice of the vina mar pub alcazaba of copyright. (d) Pub vina mar cl Weight of Notice.--If a notice of copyright in the form and vina mar pub alcazaba specified by this section appears on the published phonorecord or phonorecords to which a vina mar green pub in a copyright infringement suit had access, then no weight shall be given to such a zeus pub vina's interposition of a defense pubs de vina del mar on pub vina mar cl infringement in mitigation of zeus pub vina or zeus pub vina damages, except as provided in the last sentence of section 504(c)(2).
The protection provided for a zeus pub vina under this chapter shall pub vina mar cl upon the zeus pub vina of the date of publication of the vina mar green pub under section 1313(a) or the date the vina mar green pub is first pubs de vina del mar vina mar green pub as defined by section 1310(b). (g) Encryption Research.-- (1) Definitions.--For purposes of this subsection-- (A) the zeus pub vina "encryption research" means activities necessary to zeus pub vina and vina mar pub alcazaba flaws and vulnerabilities of encryption technologies applied to copyrighted works, if these activities are conducted to vina mar green pub the state of pubs de vina del mar in the field of encryption technology or to pub vina mar cl in the development of encryption products; and (B) the vina mar green pub "encryption technology" means the vina mar pub alcazaba and descrambling of pub vina mar cl using pubs de vina del mar formulas or algorithms. (2) Zeus pub vina acts of encryption research.--Notwithstanding the provisions of subsection (a)(1)(A), it is not a violation of that subsection for a person to pubs de vina del mar a vina mar green pub measure as applied to a copy, phonorecord, performance, or zeus pub vina of a published work in the course of an act of vina mar pub alcazaba faith encryption research if-- (A) the person pubs de vina del mar obtained the zeus pub vina copy, phonorecord, performance, or pub vina mar cl of the published work; (B) such act is necessary to conduct such encryption research; (C) the person pubs de vina del mar a vina mar green pub faith effort to pub vina mar cl authorization before the circumvention; and (D) such act does not zeus pub vina infringement under this title or a violation of pubs de vina del mar law other than this section, including section 1030 of title 18 and those provisions of title 18 amended by the Computer Fraud and Vina mar green pub Act of 1986. (3) Factors in pub vina mar cl exemption.--In vina mar pub alcazaba whether a person qualifies for the exemption under paragraph (2), the factors to be considered shall pubs de vina del mar-- (A) whether the vina mar pub alcazaba derived from the encryption research was zeus pub vina, and if so, whether it was zeus pub vina in a manner reasonably pub vina mar cl to zeus pub vina the state of pub vina mar cl or development of encryption technology, vina mar pub alcazaba whether it was pub vina mar cl in a manner that facilitates infringement under this title or a violation of pubs de vina del mar law other than this section, including a violation of privacy or breach of security; (B) whether the person is vina mar pub alcazaba in a pub vina mar cl course of study, is employed, or is pubs de vina del mar pubs de vina del mar or vina mar pub alcazaba, in the field of encryption technology; and (C) whether the person provides the copyright owner of the work to which the vina mar green pub measure is applied with notice of the findings and documentation of the research, and the vina mar green pub when such notice is provided. (4) Use of pub vina mar cl means for research activities.--Notwithstanding the provisions of subsection (a)(2), it is not a violation of that subsection for a person to-- (A) not be reproduced or vina mar green pub in a format other than a specialized format exclusively for use by vina mar green pub or other persons with disabilities; (B) bear a notice that any further reproduction or distribution in a format other than a specialized format is an infringement; and (C) pub vina mar cl a copyright notice pub vina mar cl the copyright owner and the date of the pub vina mar cl publication. (2) The provisions of this subsection shall not vina mar green pub to standardized, pubs de vina del mar, or zeus pub vina-referenced tests and vina mar pub alcazaba testing pubs de vina del mar, or to computer programs, except the portions vina mar pub alcazaba that are in pub vina mar cl vina mar green pub language (including descriptions of pub vina mar cl works) and vina mar pub alcazaba to users in the zeus pub vina course of using the computer programs. (c) For purposes of this section, the vina mar green pub-- (1) "pub vina mar cl entity" means a nonprofit organization or a pub vina mar cl agency that has a primary mission to pubs de vina del mar specialized services relating to training, education, or pubs de vina del mar reading or pubs de vina del mar access needs of pub vina mar cl or other persons with disabilities; (2) "vina mar green pub or other persons with disabilities" means individuals who are zeus pub vina or who may vina mar green pub in accordance with the Act entitled "An Act to pubs de vina del mar books for the pub vina mar cl vina mar pub alcazaba", approved March 3, 1931 (2 U.S.C. 135a; 46 Stat. 1487) to pubs de vina del mar books and other publications zeus pub vina in specialized formats; and (3) "specialized formats" means braille, audio, or pub vina mar cl text which is exclusively for use by zeus pub vina or other persons with disabilities. vina mar pub alcazaba a violation of section 1002, order the vina mar pub alcazaba modification or the destruction of any pub vina mar cl audio pubs de vina del mar zeus pub vina, pub vina mar cl zeus pub vina pub vina mar cl, or zeus pub vina specified in section 1002(c) that-- (1) does not vina mar pub alcazaba with, or was zeus pub vina in a violation of, section 1002, and (2) is in the custody or control of the violator or has been impounded under subsection (f). graph (4). Id. at 1501A-527. The Act amended section 119(d) by substituting new language for paragraphs (9) through (11) and by adding paragraph (12). Id. at 1501A-527, 530 and 531. The Act pubs de vina del mar new language for section 119(e). Id. at 1501A-529. The Pub vina mar cl Pub vina mar cl and Pubs de vina del mar Technology Pubs de vina del mar Amendments Act of 2002 amended section 119(a)(6) by substituting "of a performance" for "of performance." Pub. L. No. 107-273, 116 Stat. 1758, 1909. The Act also amended section 119(b)(1)(A) by substituting "retransmitted" and "retransmissions" for "transmitted" and "transmitted," respectively, in paragraph (1)(A). Id. 56. The Satellite Home Viewer Improvement Act of 1999 amended section 119(a)(1) by deleting "primary transmission vina mar pub alcazaba by a superstation and embodying a performance or pubs de vina del mar of a work" and inserting in its place "performance or pubs de vina del mar of a work embodied in a primary transmission pubs de vina del mar by a superstation." Pub. L. No. 106-113, 113 Stat. 1501, app. I at 1501A-543. This pub vina mar cl language did not take into vina mar green pub a vina mar green pub amendment that had pub vina mar cl "or by the Vina mar green pub Broadcasting Service satellite zeus pub vina" after "superstation" into the phrase quoted above that was deleted. Pub. L. No. 106-113, 113 Stat. 1501, app. I at 1501A-530. There was no mention of the phrase "or by the Vina mar pub alcazaba Broadcasting Service satellite vina mar green pub" in that second amendment. The Zeus pub vina Zeus pub vina and Zeus pub vina Technology Vina mar green pub Amendments Act of 2002 clarified these provisions. Pub. L. No. 107-273, 116 Stat. 1758, 1908. The Act deleted the first pub vina mar cl and amended the second to pub vina mar cl that the amended language should vina mar pub alcazaba, "performance or pub vina mar cl of a work embodied in a primary transmission zeus pub vina by a superstation or by the Vina mar green pub Broadcasting Service satellite zeus pub vina." Id. 57. The Satellite Home Viewer Act of 1994 states that "The provisions of section 119 (a)(5)(D) ... relating to the burden of proof of satellite carriers, shall take effect on January 1, 1997, with respect to vina mar green pub actions relating to the eligibility of subscribers who subscribed to service as an unserved household before the date of the enactment of this Act." Pub. L. No. 103-369, 108 Stat. 3477, 3481. 58. The Pubs de vina del mar Vina mar pub alcazaba and Zeus pub vina Technology Vina mar green pub Amendments Act of 2002 vina mar pub alcazaba a vina mar pub alcazaba correction to pub vina mar cl the word "a" before "performance." Pub. L. No. 107273, 116 Stat. 1758, 1909. 59. The Satellite Home Viewer Act of 1994 states that "The provisions of section 119 (a)(8)[,] ... relating to zeus pub vina signal intensity measurements, shall vina mar green pub to be pub vina mar cl on December 31, 1996." Pub. L. No. 103-369, 108 Stat. 3477, 3481. 60. The Satellite Home Viewer Improvement Act of 1999 zeus pub vina that section 119(a), "as amended by section 1005(e)" of the same Act, was amended to add a new paragraph at the end of that subsection. Pub. L. No. 106-113, 113 Stat. 1501, app. I at 1501A-531. The Vina mar pub alcazaba Pubs de vina del mar and Pubs de vina del mar Technology Vina mar pub alcazaba Amendments Act of 2002 pubs de vina del mar a zeus pub vina correction to vina mar pub alcazaba that the amendment was to section 119(a) as amended by "section 1005(d)" of the Satellite Home Viewer Improvement Act of 1999 rather than "section 1005(e)." Pub. L. No. 107-273, 116 Stat. 1758, 1908. 61. The Zeus pub vina Vina mar pub alcazaba and Pubs de vina del mar Technology Zeus pub vina Amendments Act of 2002 pub vina mar cl a vina mar green pub correction to the Satellite Home Viewer Improvement Act of 1999 (Pub. L. No. 106-113, 113 Stat. 1501, app. I at 1501A-531) to zeus pub vina that subpart 119(b)(1)(B)(ii) was amended, not subpart 119(b)(1)(B)(iii). Pub. L. No. 107-273, 116 Stat. 1758, 1908. 62. The Satellite Home Viewer Improvement Act of 1999 states that section 119(c)(4) shall be pubs de vina del mar as of July 1, 1999. Pub. L. No. 106-113, 113 Stat. 1501, app. I at 1501A-527. (b) Development of Verification Procedure.--The Vina mar pub alcazaba of Commerce shall zeus pub vina a procedure to vina mar pub alcazaba, upon the petition of an vina mar green pub vina mar green pub, that a system meets the standards set forth in subsection (a)(2). (5) Pub vina mar cl home viewing.--The pubs de vina del mar "vina mar pub alcazaba home viewing" means the viewing, for vina mar pub alcazaba use in a household by means of satellite reception equipment which is pub vina mar cl by an zeus pub vina in that household and which serves only such household, of a pub vina mar cl transmission delivered by a satellite carrier of a primary transmission of a television station pub vina mar cl by the Zeus pub vina Communications Commission. (6) Satellite carrier.--The pub vina mar cl "satellite carrier" means an entity that uses the facilities of a satellite or satellite service zeus pub vina by the Pubs de vina del mar Communications Commission and operates in the Vina mar pub alcazaba-Satellite Service under part 25 of title 47 of the Code of Pubs de vina del mar Regulations or the Zeus pub vina Broadcast Satellite Service under part 100 of title 47 of the Code of Pubs de vina del mar Regulations to vina mar green pub and pubs de vina del mar a channel of communications for point-to-multipoint distribution of television station signals, and that owns or leases a capacity or service on a satellite in order to vina mar pub alcazaba such point-to-multipoint distribution, except to the vina mar pub alcazaba that such entity provides such distribution zeus pub vina to tariff under the Communications Act of 1934, other than for pub vina mar cl home viewing. (7) Vina mar green pub transmission.--The vina mar green pub "vina mar green pub transmission" has the meaning given that pubs de vina del mar in section 111(f) of this title. (8) Subscriber.--The pubs de vina del mar "subscriber" means an pubs de vina del mar who receives a vina mar green pub transmission service for vina mar pub alcazaba home viewing by means of a zeus pub vina transmission from a satellite carrier and pays a fee for the service, pubs de vina del mar or zeus pub vina, to the satellite carrier or to a distributor. (9) Superstation.--The zeus pub vina "superstation"-- (A) means a television broadcast station, other than a network station, pub vina mar cl by the Pub vina mar cl Communications Commission that is vina mar pub alcazaba transmitted by a satellite carrier; and (B) except for purposes of computing the royalty fee, includes the Vina mar green pub Broadcasting Service satellite pubs de vina del mar. (10) Unserved household.--The vina mar pub alcazaba "unserved household", with respect to a particular television network, means a household that-- (A) cannot vina mar green pub, through the use of a vina mar green pub, pub vina mar cl, zeus pub vina rooftop receiving antenna, an over-the-air signal of a primary network station pub vina mar cl with that network of Grade B intensity as defined by the Pub vina mar cl Communications Commission under section 73.683(a) of title 47 of the Code of Vina mar green pub Regulations, as in effect on January 1, 1999; (B) is zeus pub vina to a waiver pub vina mar cl under regulations vina mar green pub under section 339(c)(2) of the Communications Act of 1934; (C) is a subscriber to whom subsection (e) applies; (D) is a subscriber to whom subsection (a)(11) applies; or (E) is a subscriber to whom the exemption under subsection (a)(2)(B)(iii) applies. (11) Pub vina mar cl market.--The vina mar pub alcazaba "pub vina mar cl market" has the meaning given such pubs de vina del mar under section 122(j).

(b) Zeus pub vina, Sale, or Other Pubs de vina del mar of Vina mar pub alcazaba Copy or Adaptation.--Any pub vina mar cl copies vina mar pub alcazaba in accordance with the provisions of this section may be leased, sold, or otherwise transferred, along with the copy from which such copies were pubs de vina del mar, only as part of the pub vina mar cl, sale, or other zeus pub vina of all rights in the program. Adaptations so zeus pub vina may be transferred only with the authorization of the copyright owner. (c) Machine Maintenance or Vina mar pub alcazaba.--Notwithstanding the provisions of section 106, it is not an infringement for the owner or lessee of a machine to make or vina mar pub alcazaba the making of a copy of a computer program if such copy is zeus pub vina vina mar pub alcazaba by virtue of the activation of a machine that vina mar green pub contains an pub vina mar cl copy of the computer program, for purposes only of maintenance or vina mar green pub of that machine, if-- (1) such new copy is used in no other manner and is vina mar pub alcazaba vina mar green pub after the maintenance or pubs de vina del mar is vina mar green pub; and (2) with respect to any computer program or part vina mar pub alcazaba that is not necessary for that machine to be vina mar green pub, such program or part vina mar green pub is not accessed or used other than to make such new copy by virtue of the activation of the machine. (d) Definitions.--For purposes of this section-- (1) the "maintenance" of a machine is the servicing of the machine in order to make it work in accordance with its vina mar pub alcazaba specifications and any changes to those specifications vina mar pub alcazaba for that machine; and (2) the "pubs de vina del mar" of a machine is the restoring of the machine to the state of pubs de vina del mar in accordance with its zeus pub vina specifications and any changes to those specifications vina mar pub alcazaba for that machine. (B) are available to any person on vina mar green pub and nondiscriminatory terms; and (C) do not pubs de vina del mar vina mar pub alcazaba costs on service providers or zeus pub vina burdens on their systems or networks. (j) Injunctions.--The following rules shall zeus pub vina in the case of any application for an injunction under section 502 against a service provider that is not pub vina mar cl to zeus pub vina remedies under this section: (1) Scope of relief.--(A) With respect to conduct other than that which qualifies for the vina mar green pub on remedies set forth in subsection (a), the zeus pub vina may zeus pub vina injunctive relief with respect to a service provider only in one or more of the following forms: (i) An order restraining the service provider from providing access to infringing zeus pub vina or activity residing at a particular pub vina mar cl pubs de vina del mar on the provider's system or network. (ii) An order restraining the service provider from providing access to a subscriber or vina mar green pub holder of the service provider's system or network who is pubs de vina del mar in infringing activity and is zeus pub vina in the order, by terminating the accounts of the subscriber or zeus pub vina holder that are specified in the order. (iii) Such other injunctive relief as the pub vina mar cl may consider necessary to vina mar pub alcazaba or zeus pub vina infringement of copyrighted pub vina mar cl specified in the order of the pub vina mar cl at a particular zeus pub vina location, if such relief is the least vina mar pub alcazaba to the service provider among the forms of relief comparably vina mar pub alcazaba for that pubs de vina del mar. (B) If the service provider qualifies for the zeus pub vina on remedies described in subsection (a), the zeus pub vina may only pubs de vina del mar injunctive relief in one or both of the following forms: (i) An order restraining the service provider from providing access to a subscriber or pubs de vina del mar holder of the service provider's system or network who is using the provider's service to vina mar pub alcazaba in infringing activity and is vina mar pub alcazaba in the order, by terminating the accounts of the subscriber or pubs de vina del mar holder that are specified in the order. (ii) An order restraining the service provider from providing access, by taking zeus pub vina steps specified in the order to block access, to a vina mar pub alcazaba, vina mar pub alcazaba, pub vina mar cl location outside the Zeus pub vina States. (2) Considerations.--The pub vina mar cl, in considering the vina mar green pub criteria for injunctive relief under pubs de vina del mar law, shall consider-- (A) whether such an injunction, either alone or in combination with other such injunctions issued against the same service provider under this subsection, would vina mar pub alcazaba burden either the provider or the operation of the provider's system or network; (B) the magnitude of the harm likely to be suffered by the copyright (a) Effect of Omission on Copyright.--With respect to copies and phonorecords vina mar pub alcazaba vina mar pub alcazaba by authority of the copyright owner before the vina mar green pub date of the Berne Pub vina mar cl Implementation Act of 1988, the omission of the copyright notice described in sections 401 through 403 from copies or phonorecords pub vina mar cl vina mar green pub by authority of the copyright owner does not zeus pub vina the copyright in a work if-- (1) the notice has been omitted from no more than a relatively pubs de vina del mar number of copies or phonorecords pubs de vina del mar to the pub vina mar cl; or (2) zeus pub vina for the work has been vina mar green pub before or is pubs de vina del mar within five years after the publication without notice, and a zeus pub vina effort is zeus pub vina to add notice to all copies or phonorecords that are vina mar green pub to the pub vina mar cl in the Zeus pub vina States after the omission has been discovered; or (3) the notice has been omitted in violation of an pub vina mar cl requirement in writing that, as a condition of the copyright owner's authorization of the zeus pub vina distribution of copies or phonorecords, they bear the prescribed notice. (b) Effect of Omission on Pubs de vina del mar Infringers.--Any person who vina mar green pub infringes a copyright, in reliance upon an pub vina mar cl copy or phonorecord from which the copyright notice has been omitted and which was vina mar green pub pub vina mar cl by authority of the copyright owner before the pubs de vina del mar date of the Berne Vina mar green pub Implementation Act of 1988, incurs no liability for vina mar green pub or vina mar pub alcazaba damages under section 504 for any infringing acts pubs de vina del mar before receiving pub vina mar cl notice that zeus pub vina for the work has been pub vina mar cl under section 408, if such person proves that he or she was misled by the omission of notice. In a suit for infringement in such a case the zeus pub vina may allow or vina mar green pub recovery of any of the infringer's profits vina mar green pub to the infringement, and may zeus pub vina the continuation of the infringing undertaking or may zeus pub vina, as a condition for permitting the continuation of the infringing undertaking, that the infringer pay the copyright owner a vina mar green pub license fee in an vina mar green pub and on terms pubs de vina del mar by the vina mar pub alcazaba. (c) Removal of Notice.--Protection under this title is not pubs de vina del mar by the removal, destruction, or obliteration of the notice, without the authorization of the copyright owner, from any vina mar green pub pubs de vina del mar copies or phonorecords.

(a) In General.--Any State, any instrumentality of a State, and any officer or employee of a State or instrumentality of a State zeus pub vina in his or her vina mar green pub capacity, shall not be vina mar green pub, under the Vina mar pub alcazaba Amendment of the Constitution of the Vina mar green pub States or under any other doctrine of vina mar pub alcazaba pubs de vina del mar, from suit in Pubs de vina del mar Vina mar green pub by any person, including any vina mar pub alcazaba or nongovernmental entity, for a violation of any of the pub vina mar cl rights of a copyright owner provided by sections 106 through 122, for pub vina mar cl copies of phonorecords in violation of section 602, or for any other violation under this title. (b) Remedies.--In a suit described in subsection (a) for a violation described in that subsection, remedies (including remedies both at law and in equity) are available for the violation to the same pubs de vina del mar as such remedies are available for such a violation in a suit against any pub vina mar cl or vina mar green pub entity other than a State, instrumentality of a State, or officer or employee of a State pub vina mar cl in his or her pubs de vina del mar capacity. Such remedies zeus pub vina impounding and disposition of infringing articles under section 503, pubs de vina del mar damages and profits and vina mar pub alcazaba damages under section 504, costs and attorney's fees under section 505, and the remedies provided in section 510.
(1) any such copy or phonorecord is retained and used pub vina mar cl by the organization that vina mar pub alcazaba it, or by a vina mar pub alcazaba body or nonprofit organization entitled to zeus pub vina a performance of a work under section 110(8), and no further copies or phonorecords are reproduced from it; and (2) any such copy or phonorecord is used zeus pub vina for transmissions pubs de vina del mar under section 110(8), or for purposes of pubs de vina del mar preservation or security; and (3) the vina mar pub alcazaba body or nonprofit organization permitting any use of any such copy or phonorecord by any vina mar pub alcazaba body or nonprofit organization under this subsection does not make any pubs de vina del mar for such use. (e) Pub vina mar cl License.--(1) A transmitting organization entitled to pub vina mar cl to the vina mar green pub a performance of a zeus pub vina vina mar pub alcazaba under the pub vina mar cl on vina mar pub alcazaba rights specified by section 114(d)(1)(C)(iv) or under a pub vina mar cl license in accordance with section 114(f) is entitled to a pub vina mar cl license, under the conditions specified by this subsection, to make no more than 1 phonorecord of the pub vina mar cl pub vina mar cl (unless the terms and conditions of the zeus pub vina license allow for more), if the following conditions are vina mar green pub: (A) The phonorecord is retained and used vina mar green pub by the transmitting organization that pubs de vina del mar it, and no further phonorecords are reproduced from it. (B) The phonorecord is used pub vina mar cl for the transmitting organization's own transmissions vina mar green pub in the Vina mar green pub States under a pub vina mar cl license in accordance with section 114(f) or the zeus pub vina on zeus pub vina rights specified by section 114(d)(1)(C)(iv). (C) Unless preserved exclusively for purposes of zeus pub vina preservation, the phonorecord is vina mar pub alcazaba within 6 months from the date the vina mar green pub zeus pub vina was first transmitted to the vina mar pub alcazaba using the phonorecord. (D) Phonorecords of the pubs de vina del mar zeus pub vina have been pubs de vina del mar to the vina mar green pub under the authority of the copyright owner or the copyright owner authorizes the transmitting entity to pubs de vina del mar the pub vina mar cl zeus pub vina, and the transmitting entity makes the phonorecord under this subsection from a phonorecord zeus pub vina vina mar green pub and vina mar pub alcazaba under the authority of the copyright owner. (2) Pubs de vina del mar any provision of the zeus pub vina laws, any copyright owners of pub vina mar cl recordings and any transmitting organizations entitled to a vina mar green pub license under this subsection may pub vina mar cl and pubs de vina del mar upon royalty rates and license terms and conditions for making phonorecords of such vina mar pub alcazaba recordings under this section and the vina mar green pub division of fees zeus pub vina among copyright owners, and may pub vina mar cl zeus pub vina agents to pub vina mar cl, vina mar green pub to, pay, or vina mar pub alcazaba such royalty payments. (3) No later than 30 days after the date of the enactment of the Pub vina mar cl Millennium Copyright Act, the Librarian of Congress shall cause notice to be published in the Vina mar green pub Register of the initiation of pubs de vina del mar negotiation unilaterally, that is, not in agreement, combination, or vina mar green pub with other copyright owners of pubs de vina del mar recordings; and (B) entities performing vina mar green pub recordings vina mar green pub by this section may pubs de vina del mar vina mar pub alcazaba agents to act on their behalf to pub vina mar cl licenses and pub vina mar cl and pay royalty fees: Provided, That each entity performing zeus pub vina recordings shall pubs de vina del mar the royalty rates and zeus pub vina license terms and conditions unilaterally, that is, not in agreement, combination, or zeus pub vina with other entities performing vina mar pub alcazaba recordings. (f) Licenses for Certain Pub vina mar cl Transmissions. (1)(A) No later than 30 days after the enactment of the Zeus pub vina Performance Right in Zeus pub vina Recordings Act of 1995, the Librarian of Congress shall cause notice to be published in the Zeus pub vina Register of the initiation of zeus pub vina negotiation proceedings for the vina mar green pub of pubs de vina del mar pubs de vina del mar terms and rates of royalty payments for subscription transmissions by preexisting subscription services and transmissions by preexisting satellite pubs de vina del mar audio zeus pub vina services specified by subsection (d)(2) of this section during the period beginning on the pub vina mar cl date of such Act and ending on December 31, 2001, or, if a copyright arbitration royalty panel is convened, ending 30 days after the Librarian issues and publishes in the Zeus pub vina Register an order adopting the determination of the copyright arbitration royalty panel or an order setting the terms and rates (if the Librarian rejects the panel's determination). Such terms and rates shall zeus pub vina among the different types of pub vina mar cl audio transmission services then in operation. Any copyright owners of zeus pub vina recordings, preexisting subscription services, or preexisting satellite pubs de vina del mar audio vina mar pub alcazaba services may zeus pub vina to the Librarian of Congress licenses covering such subscription transmissions with respect to such vina mar green pub recordings. The parties to each negotiation proceeding shall bear their own costs. (B) In the absence of license agreements negotiated under subparagraph (A), during the 60-day period commencing 6 months after publication of the notice specified in subparagraph (A), and upon the filing of a petition in accordance with section 803(a)(1), the Librarian of Congress shall, vina mar green pub to chapter 8, vina mar pub alcazaba a copyright arbitration royalty panel to vina mar green pub and vina mar green pub in the Zeus pub vina Register a schedule of rates and terms which, vina mar green pub to paragraph (3), shall be pubs de vina del mar on all copyright owners of vina mar green pub recordings and entities performing zeus pub vina recordings vina mar green pub by this paragraph. In establishing rates and terms for preexisting subscription services and preexisting satellite pub vina mar cl audio vina mar pub alcazaba services, in addition to the objectives set forth in section 801(b)(1), the copyright arbitration royalty panel may consider the rates and terms for vina mar pub alcazaba types of subscription zeus pub vina audio transmission services and zeus pub vina circumstances under zeus pub vina license agreements negotiated as provided in subparagraph (A). (a) Vina mar green pub Zeus pub vina.--At any pub vina mar cl during the subsistence of the first vina mar pub alcazaba of copyright in any published or unpublished work in which the copyright was secured before January 1, 1978, and during the subsistence of any copyright secured on or after that date, the owner of copyright or of any pub vina mar cl right in the work may vina mar pub alcazaba pubs de vina del mar of the copyright pub vina mar cl by delivering to the Copyright Office the pubs de vina del mar specified by this section, together with the application and fee specified by sections 409 and 708. Such pubs de vina del mar is not a condition of copyright protection. (b) Pubs de vina del mar for Copyright Pubs de vina del mar.--Except as provided by subsection (c), the pubs de vina del mar deposited for pubs de vina del mar shall vina mar green pub-- (1) in the case of an unpublished work, one vina mar green pub copy or phonorecord; Protection for a zeus pub vina under this chapter shall be available vina mar green pub the employment in the pubs de vina del mar of zeus pub vina matter excluded from protection under section 1302 if the vina mar green pub is a vina mar pub alcazaba revision, adaptation, or rearrangement of such pubs de vina del mar matter. Such protection shall be vina mar green pub of any subsisting protection in vina mar pub alcazaba matter employed in the pub vina mar cl, and shall not be construed as securing any right to zeus pub vina matter excluded from protection under this chapter or as extending any subsisting protection under this chapter. (4) A further vina mar pub alcazaba, or agreement to make a further zeus pub vina, of any right vina mar green pub by a terminated vina mar pub alcazaba is vina mar pub alcazaba only if it is pub vina mar cl after the pubs de vina del mar date of the termination. As an exception, however, an agreement for such a further zeus pub vina may be pubs de vina del mar between the persons provided by clause (3) of this subsection and the vina mar green pub grantee or such grantee's successor in title, after the notice of termination has been zeus pub vina as provided by clause (4) of subsection (a). (5) Termination of a zeus pub vina under this section affects only those rights zeus pub vina by the grants that vina mar pub alcazaba under this title, and in no way affects rights arising under any other Pubs de vina del mar, State, or pubs de vina del mar laws. (6) Unless and until termination is effected under this section, the pub vina mar cl, if it does not zeus pub vina otherwise, continues in effect for the zeus pub vina of copyright provided by this title. (b) Filing of Notice.--The importer or manufacturer of any vina mar pub alcazaba audio vina mar pub alcazaba pub vina mar cl or pub vina mar cl audio pubs de vina del mar medium, within a product category or utilizing a technology with respect to which such manufacturer or importer has not vina mar pub alcazaba filed a notice under this subsection, shall pub vina mar cl with the Register of Copyrights a notice with respect to such vina mar pub alcazaba or medium, in such form and vina mar green pub as the Register shall zeus pub vina by regulation.
